This lock, known as the “LV Tournant,” was designed by independent designer Jocelyne Imbert in 1988.

A specific contract was signed between the designer and Louis Vuitton in 1992, which stipulated that if the lock was used in other collections, Imbert would receive an additional revenue of 76,000 euros due to the copyright she held over the design.

However, things took a turn in 2014 when Jocelyn Imbert discovered that the lock was being used in Louis Vuitton’s new Twist line and other products.

Despite Louis Vuitton’s claim that the 1992 agreement granted them the right to use the lock on any product without additional compensation, the Paris Court of Appeal ordered the luxury brand to pay 900,000 euros to Imbert, citing a breach of contract.

The Ad Campaign Music Lawsuit

In a more recent case, Louis Vuitton was hit with a copyright lawsuit over the music used in a 2021 advertising campaign featuring Chiara Ferragni.

The music publisher Discomoda U.S.A. Corp. and others alleged that the French fashion house made unauthorised use of the song “Por Alguien Como Tu” in the campaign.

The song, co-authored by Claudio Gamez and Julio Andres Morean Sosa, was first recorded by their band, Los Darts, in Venezuela in 1970.

Despite Louis Vuitton’s claims, Discomoda argued that the brand’s version copied significant elements from the original song, including its melody, harmony, and rhythm.

As a result, they deemed it an “unauthorised derivative work” that infringed on their copyright.

The Delhi High Court’s Interim Relief

Louis Vuitton Malletier sought relief from the Delhi High Court against the shopping website www.haute24.com and others for unauthorised use of its photographs.

The court granted interim relief to Louis Vuitton, acknowledging a clear prima facie case of copyright infringement.
